DUI - Questions to Ask
|
Referred to as Florida DUI lawyer, Florida drunk driving lawyer, or Florida DWI lawyer: all lawyers that defend DUI,
DWI, or drunk driving cases in Florida should immediately discuss with you the 10 day rule.
In Florida, when someone is arrested for a DUI, there are really two separate cases that arise:
(1) the criminal court case, where a jail sentence is possible, and (2) the Adminstrative hearing.
This hearing is given by the Florida Department of Highway Safety Motor Vehicles.
If the lawyer does not discuss this with you, then speak to another lawyer.
If you have been arrested for DUI, and you refused to give a a breath, blood or urine sample, OR if you took the
test and your result is 0.08% or higher, you have only 10 days to request a special hearing with the FDHSMV to save
your license. Failure to timely request a hearing will result in a penalty of at least a 6 month suspension (and as
much as an 18-month suspension) of your Florida driving privileges. Again, if you don't file within the 10 days,
you lose your right to challenge the suspension.
While speaking with the Florida DUI / DWI lawyer, ask him/her how under under Florida law can a DUI be proved. The
lawyer should tell you that drunk driving can be proved by impairment of normal faculties, or unlawful breath or
blood alcohol level of .08% or above. The penalty does not change if they prove by alcohol level ot impairment.
The penalties and consequences for a Florida DUI arrest are serious and far-reaching. Beyond the fines, jail, vehicle
immobilization, counciling, court costs, probation, community service hours and license suspension, you have to
consider the impact that this will have on your insurance premiums and employability.
